Kim Zolciak wants Kroy Biermann divorce dismissed again, claims they’re having plenty of sex

Kim Zolciak wants Kroy Biermann’s divorce filing to be dismissed again – claiming they’re having plenty of sex, which means the marriage isn’t broken.

The “Real Housewives of Atlanta” alum responded to the retired NFL player’s second request for dissolution Tuesday afternoon, alleging that they’ve had “marital sexual relations on multiple occasions” since Biermann filed.

Zolciak claims in the court documents, obtained by Page Six, that Biermann’s allegation that the marriage is “irretrievably broken” is “demonstrably false” because they’ve “resumed cohabitation” for some time now.

She believes their longtime marriage is “viable” and is hoping the judge tosses out Biermann’s petition.

Biermann’s attorney didn’t immediately return Page Six’s request for comment.

TMZ was first to report the news of the dismissal.

The former Atlanta Falcons player filed for divorce for the second time on Aug. 24, weeks after the estranged couple attempted to split but ultimately reconciled.

The “Don’t Be Tardy” alum, 45, has been claiming that she and Biermann have been “working on their marriage,” though his attorney has maintained that he’s moving forward with the divorce.

The retired linebacker has filed court documents to that effect, doubling down on claims of his estranged wife’s “abusive” behavior in front of their minor children: Kroy “KJ” Jr., 12, Kash, 11, and twins Kaia and Kane, 9.

As a result, Biermann, 38, requested a temporary legal guardian put in place to investigate Zolciak.

He also claimed Zolciak has been too “self-absorbed” to notice how they’ve become “financially destitute” amid mounting credit card lawsuits and her “reckless spending habits and love for online gambling.”

In light of what appears to be insurmountable debt, Biermann requested the judge to sign off on allowing the immediate sale of their $3 million Georgia estate, which is facing foreclosure for the second time.

“Time and time again, [Zolciak] has stated that she will not move and therefore will not cooperate in any attempt to sell the marital residence,” previously filed documents stated.

“Unfortunately, [Zolciak] is too self-absorbed to realize the impact her actions will continue to have upon the minor children.”

Biermann is requesting sole custody of their four minor kids.
