Kroy Biermann begs judge to allow the sale of $3M home with Kim Zolciak, cites serious financial issues

Kroy Biermann is asking a judge to the allow the sale of the $3 million mansion he shares with estranged wife Kim Zolciak amid their ongoing financial issues.

The former NFL player has requested an emergency hearing to get permission to put their Georgia home on the market, according to court documents obtained by Page Six.

Biermann believes the sale could help cover the “significant debt” they have racked up during their ill-fated marriage.

The retired athlete sold personal items, including designer duds, to make the monthly mortgage payments to avoid a foreclosure auction on the house earlier this year.

However, he claims in the court documents that they are facing foreclosure yet again after failing to make July’s mortgage payment.

While Kroy admits that Zolciak has also been selling her and daughter Brielle Biermann’s purses and luxury goods, he alleges that “none of the funds garnered from the sale of these items have gone towards the mortgage, or any other bills.”

The retired athlete’s filing to sell their marital home comes a week after he filed for divorce from the “Real Housewives of Atlanta” alum, 45, for a second time. They both initially filed to end their marriage in May.

According to TMZ, Kroy, 37, stated in the latest paperwork that their union is “irretrievably broken.”

He also requested sole legal and physical custody of their four minor children: Kroy Jr., 12, Kash, 11, and twins Kaia and Kane, 9.

The outlet later reported that the former couple had a massive blowout fight over finances, which prompted Kroy to pull the plug again.

“They’ve gotten ridiculously petty over who hasn’t paid bills,” a source told TMZ Friday. “They’re counting down to pennies.”

Insiders previously told Page Six that tensions had been building between the two behind closed doors due to their increasing money troubles.

He reportedly believes that sale will help cover their “significant debt.”

Not only was their mansion under foreclosure earlier this year, but news of their split coincided with reports claiming they owe the IRS more than $1 million.

Kroy also claimed in May that Zolciak’s gambling addiction had left their family “financially devastated.”

At the time, he alleged in court documents that the Bravolebrity was “spending substantial time and marital funds on gambling and other games of chance.”

Meanwhile, Saks/Capital One filed a lawsuit against Zolciak last week for more than $150,000 in unpaid credit card fees, according to court documents obtained by Page Six.

She was also sued by Target back in June for $2,482.24 in unpaid credit card bills.

Her eldest daughter, Brielle, was also hit with a lawsuit from American Express for failing to pay an outstanding balance of $12,870.25 on her credit card.

Meanwhile, Kroy has also faced legal action due to their money woes. BMW Financial Services sued the former Atlanta Falcons player earlier this summer for skipping out on car payments on a vehicle worth $400,100.

At the time, his attorney pointed the finger at Zolciak, telling TMZ, “Mr. Biermann never imagined that he would find himself in this position, having a car repossessed.

“But this is the fallout when folks find themselves spending way beyond their means. Kroy retired and no longer receives that NFL salary. … I don’t think anyone told Kim.”
